Terms of service
These terms are the agreement between you and Prolepsia for using Prolepsia: the website, forecasts and reports, the public API, the MCP server, AI connectors and the emails we send.
1. About these terms
These terms are a legally binding agreement between you and Individual entrepreneur Danyil Proskurka, the operator of the Prolepsia service (“Prolepsia”, “we” or “us”). They cover the website at app.prolepsia.com, the forecasts and reports it makes, the public API, the MCP server, the AI connectors and the emails we send. Together these are the “service”.
You accept these terms when you create an account or use the service. If you do not accept them, do not use the service.
If you use Prolepsia for an organization, such as your employer, you accept these terms for that organization and confirm that you have the authority to do so. “You” then means both you and that organization.
If your organization has signed a separate agreement with Prolepsia, that agreement controls where it conflicts with these terms.
The privacy policy explains how we handle personal data.
2. Who can use Prolepsia
- You must be at least 18 and able to enter a binding contract.
- Anyone who meets these terms may create an account. We may refuse or close an account for any lawful reason.
- You may not use the service if the law forbids it, including sanctions and export laws of the United States or other countries. You may not use it if you are on a government list of restricted parties, or if you are in a country or region under a comprehensive United States embargo.
- Give accurate account details and keep them up to date. To change the email address on your account, write to us.
3. Your account and credentials
Each person needs their own account. Do not share your login. Keep your password, API keys and AI client connections secure.
You are responsible for everything done with your account, your API keys and the AI clients you connect. This does not apply to misuse caused by our failure to keep the service secure.
If you think someone has used your account or a key without permission, revoke the affected key or connection and tell us without delay at contact@prolepsia.com.
4. Organizations
Questions, forecasts and credits belong to an organization. A personal organization has one member. A team organization can have several members.
- The admins of a team organization control it. They invite and remove members, set its sharing and file upload rules, and see its credit history.
- An admin can hand the questions a member created in the organization to another member, including after that member leaves or is removed.
- When you are removed from a team organization, you lose access to its questions and credits.
- The organization is responsible for what its members do in the service on its behalf.
5. Credits and payment
Forecasts and some features use credits from your organization's credit balance. Prolepsia shows current prices and your credit balance in the app, under Settings, Usage. The price of a forecast depends on its run mode.
- When we charge. We charge a forecast when it starts. The same rule applies however it starts: in the app, through the API or an AI connector, from a decision, or by automatic reruns or live mode. The organization that owns the question pays.
- Automatic reruns. Automatic reruns charge a monthly fee for each question while they are on. Turning on live mode for a decision turns on automatic reruns for its questions. Each forecast that automatic reruns or live mode start is charged separately. Turning automatic reruns off does not refund the current month.
- Low balance. If your credit balance cannot cover a forecast, the forecast does not start. If it cannot cover the monthly fee, automatic reruns stop until you turn them on again with enough credits.
- Returned credits. If a forecast fails, or Prolepsia cancels it, we return its credits. If you cancel a forecast, its credits are not returned, even if it had not started running. Returned credits keep the expiry date of the credits they came from.
- Buying credits. Buy available credit packs under Settings, Billing. The pricing page shows prices in US dollars before tax. Checkout shows the final amount, including any tax, before you pay.
- Online payments. Creem sells online credit packs as our reseller and merchant of record. Creem takes your payment, handles applicable taxes and sends your receipt. Prolepsia adds the credits to your organization and sends a separate confirmation. Creem's buyer terms apply to its checkout and payment services.
- Plans and agreed purchases. Plans are not sold through Creem. Contact us through the pricing page to arrange a plan or another purchase. The price and payment terms agreed in writing apply to those purchases.
- Expiry. Credit packs and starting credits never expire. Credits from Pro or Team carry over for one month. Other credits can have an expiry date, which the app shows. Credits not used by that date expire.
- Free credits. We may give free credits, such as starting credits for a new personal organization. We may change or end any free credit offer at any time.
- No cash value. Credits have no cash value. You cannot sell them, transfer them to another organization or exchange them for money. Refunds are available under Cancellations and refunds, a signed agreement or applicable law. Outside those cases, unused credits are not refunded when your account closes.
- Removing credits. We may remove credits that were added by mistake, or that were obtained by fraud or by breaking these terms.
- Price changes. We may change prices and which features use credits. A change applies only to charges made after it takes effect.
6. Cancellations and refunds
All customers have 14 days from a credit pack purchase or the first payment of a plan to cancel that purchase. The refund covers the share of the payment for credits you have not used. This offer does not limit any cancellation or refund rights the law gives you.
- Unused Creem credit packs. Open Settings, Billing and choose Cancel purchase beside the payment within 14 days. The whole payment, including any tax, is refunded through Creem. The pack's unused credits are removed from your organization.
- Partly used Creem credit packs. Email contact@prolepsia.com within 14 days to request a refund for the unused share. Include your account email and payment reference. Prolepsia reviews the request and arranges the applicable refund with Creem, including any related tax adjustment.
- Other purchases. Use Cancel purchase in Settings, Billing when it is available, or email us within 14 days. A refund removes the credits it covers. Cancelling a plan's first payment also ends that plan.
- Later requests. After 14 days, refunds are available where the law or a signed agreement requires them. Contact us if a payment or the service has a problem.
Cancelling a purchase is different from Cancel plan. Cancel plan stops the next plan payment and keeps the plan active until the end of the paid period. It does not by itself refund a payment.
7. Forecasts are estimates, not advice
Prolepsia makes forecasts with AI models and automated research. A forecast is an estimate of a probability. It is not a statement of fact and not a promise about what will happen.
- Forecasts and reports can be wrong, incomplete or out of date. They can rely on sources that are wrong, and they can misread or misquote their sources, including the links they cite. Check anything important before you rely on it.
- Forecasts are not financial, investment, trading, legal, medical, tax or other professional advice. Prolepsia does not act as your adviser. You make your own decisions and you are responsible for them.
- Do not use a forecast as the only basis for a decision that has a legal or similarly significant effect on a person, such as a decision about their job, credit, housing, insurance or education.
- Other customers may get forecasts that are similar or identical to yours.
- Accuracy figures and scores describe past forecasts. They do not promise how accurate future forecasts will be.
8. Your content
“Your content” means what you or your organization put into Prolepsia, such as questions, resolution criteria, instructions, notes, uploaded files, chat messages, decisions and feedback. It also means the forecasts, reports and other results Prolepsia makes for you.
- You keep all rights you have in your content. We do not claim ownership of it. As between you and us, the forecasts and reports made for you belong to you, to the extent the law allows anyone to own them.
- You give us a worldwide, non-exclusive and royalty-free licence to host, copy, process, send, display and change your content, and to create forecasts, reports and summaries from it. We use this licence only to provide, secure and support the service, to find and fix problems, to improve how the service works, and to meet our legal duties. Our service providers may use it on our behalf for the same purposes. The licence lasts while we hold your content.
- We do not use your content to train AI models.
- You confirm that you have the rights needed to put your content into Prolepsia, and that your content and your use of it do not break the law or anyone's rights. Do not upload information you have no right to share, such as another person's sensitive personal data, confidential information you must not disclose, or inside information about a company or a market.
- We do not have to review your content. We may remove content, or limit access to it, if we reasonably believe it breaks these terms or the law.
- If you send us ideas or feedback, we may use them freely, without paying you or owing you anything.
9. How we treat your content
We treat your content as confidential and use it only as these terms and the privacy policy describe.
- Authorized Prolepsia staff can read your content, including private questions, when they need to give you support, run and check the service, find and fix a problem, investigate misuse, or meet a legal duty.
- We do not make a question you created public without your agreement.
- We disclose content when the law requires it. Where the law allows and it is reasonable, we tell you first.
11. Public forecasts
Prolepsia publishes some forecasts on its public pages. You may read, link to and quote them for any lawful purpose, if you name Prolepsia as the source and link to the original page.
Without our written permission, you may not copy public forecasts in bulk, sell them, present them as your own work, or use them to train or test AI models.
12. Acceptable use
You must not use the service, or help anyone else use it, to:
- break the law, or infringe anyone's intellectual property, privacy or other rights;
- harass, threaten, defame or harm anyone, or forecast the health, death, location or private life of a private individual;
- plan, encourage or profit from violence, crime or terrorism;
- trade on or disclose inside information, manipulate any financial or prediction market, or break the rules of a market or forecasting competition you take part in;
- get into an account, system or data without permission, or test the security of the service without our written permission;
- avoid credit charges, usage limits, rate limits, permissions or other safeguards, for example by opening extra accounts or organizations to get more free credits;
- copy or collect content from the service by automated means, other than through the public API and AI connectors as documented;
- take apart the service or try to extract its source code, prompts or methods, except where the law allows this despite these terms;
- resell or rent access to the service itself, or let other people use your account or API keys, without our written permission;
- build a competing forecasting service, or train or test an AI model meant to compete with Prolepsia;
- send malware or spam, or put an unreasonable load on the service or on the services it uses; or
- present a forecast as certain, as advice from a human expert, or as something Prolepsia endorses.
We may investigate a suspected breach and work with the authorities where the law requires or allows it.
13. API, AI connectors and automation
- The public API and the MCP server let programs and AI clients use Prolepsia on your behalf. These terms apply to that use.
- Follow the developer documentation and the usage limits we publish there. We may change the API. Before a change that breaks existing use, we try to give reasonable notice.
- An AI client you connect, such as ChatGPT, Claude or Perplexity, acts with the permissions you approve. What it does through your connection counts as done by you, and it uses credits in the same way.
- Webhooks send event notices to the address you choose. You are responsible for the systems that receive them.
- We may limit, suspend or revoke an API key or a connection that puts the service at risk or breaks these terms.
14. Third-party services
The service works with services run by other companies. These include the AI clients you connect, Telegram, Google login, the websites and data sources a forecast reads, and the forecasting sites you import questions from. Their own terms and privacy policies apply when you use them.
We do not control those services and are not responsible for them, their content or their availability. A link to a source, or a citation of it, does not mean we endorse it.
15. Our rights in the service
Prolepsia owns the service, including its software, design, prompts, documentation, name and logo. While you have an account, we give you a limited, non-exclusive, non-transferable and revocable right to use the service under these terms. We keep every right we do not give you in these terms.
You may name Prolepsia as the source of a forecast. Do not use our name or logo in a way that suggests we endorse you, your organization or your product, without our written permission.
16. Changes to the service
We improve the service often. We may add, change or remove features, models and run modes. Features we describe as early or experimental may change or end without notice.
If we decide to close the whole service, we will tell you at least 30 days before, unless the law, a security risk or events outside our control prevent it.
17. Suspension and closing your account
- You may stop using the service at any time. To close your account, write to us. Before it closes, you can download the reports you want to keep.
- We may suspend or limit your access at once if you break these terms, if your use puts the service, other users or anyone else at risk, if the law requires it, or if you do not pay what you owe. Where it is reasonable, we tell you why and give you a chance to fix the problem first.
- We may close your account for a serious or repeated breach of these terms. We may also close it for any other reason by giving you 30 days' notice.
- When your account closes, your right to use the service ends and unused credits lapse, subject to Cancellations and refunds and any refund the law or a signed agreement requires. We keep or delete your data as the privacy policy describes.
- Terms that by their nature should continue after your account closes still apply. These include amounts owed, the licence for content we still hold, disclaimers, limits on liability, claims caused by business users, and governing law and disputes.
18. Disclaimers
To the fullest extent the law allows, we provide the service, forecasts and all other results “as is” and “as available”. We give no warranties or conditions of any kind, whether express or implied. This includes any warranty of merchantability, fitness for a particular purpose, title, non-infringement or accuracy, and any warranty that the service will be uninterrupted, secure or free of errors. We do not promise that any forecast will be accurate, or that any event will or will not happen.
Some laws do not allow some of these exclusions. Where that is the case, they apply only as far as the law allows.
19. Limits on liability
To the fullest extent the law allows:
- Prolepsia is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages. It is not liable for lost profits, revenue, business, goodwill or data, or for losses from decisions or trades made using a forecast. This applies even if we were told such losses were possible.
- Prolepsia's total liability for all claims about the service or these terms is limited to the greater of the amount you paid for the service, including purchases through Creem, in the 12 months before the event that caused the claim, and 100 US dollars.
These limits do not apply to liability that the law does not allow us to limit. This includes liability for fraud, for gross negligence or wilful misconduct, and for death or personal injury caused by our negligence. If you are a consumer explains how these limits apply to consumers.
20. Claims caused by business users
This section applies only if you use the service for a business or an organization. You will defend Prolepsia and its staff against claims by third parties, and cover the resulting losses, costs and reasonable legal fees, where the claim comes from your content, from your breach of these terms, or from your breach of the law.
We will tell you promptly about such a claim, let you control the defence, and give reasonable help at your cost. You may not settle a claim in a way that admits fault for us or binds us without our written consent.
21. If you are a consumer
You are a consumer if you use the service mainly for purposes outside your trade, business or profession.
- Nothing in these terms takes away rights that the consumer law of the country where you live gives you and that a contract cannot change.
- If you are a consumer in the European Union or the United Kingdom, Disclaimers and Limits on liability do not limit our liability for loss caused intentionally or by gross negligence. For loss caused by slight negligence, we are liable only if we break a duty that is essential to this contract, and only for the foreseeable loss typical for a contract of this kind. Your legal rights when a digital service is faulty also apply.
- The offer in Cancellations and refunds applies to all customers. It does not replace any longer cancellation period, refund or other remedy that consumer law gives you.
- You may bring a claim in the courts of the country where you live.
22. Governing law and disputes
- The laws of Georgia govern these terms and any dispute about them or the service. Georgia's rules on choosing another country's law do not apply. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
- Before starting a court case, write to us at contact@prolepsia.com and describe the dispute. We both try in good faith to settle it within 30 days.
- Any court case must be brought in the courts in Tbilisi, Georgia, unless consumer law gives you a right to use another court. You and we agree to those courts having jurisdiction. Either of us may ask any court for an urgent order to protect intellectual property or confidential information.
- If you are a consumer, the protections described in If you are a consumer apply in addition to this section.
23. Changes to these terms
We may update these terms. We post the new version on this page with its effective date. Before a material change takes effect, we tell you by email or in Prolepsia and give you reasonable time to read it.
If you keep using the service after the change takes effect, you accept the new terms. If you do not accept them, stop using the service and ask us to close your account. A change does not apply to a dispute that arose before the change took effect.
24. General terms
- Whole agreement. These terms, together with any signed agreement with your organization and the documents they refer to, are the whole agreement between you and us about the service.
- Transfer. You may not transfer these terms without our written consent. We may transfer them to a company in our group or to a buyer of our business, and we will tell you when we do.
- Events outside our control. We are not liable for a delay or failure caused by events outside our reasonable control. These include outages at the providers we rely on, attacks on the service, natural disasters and actions of governments.
- Notices. We send notices to the email address on your account or show them in Prolepsia. Send notices to us at contact@prolepsia.com.
- Severability. If a court finds part of these terms unenforceable, that part applies as far as the law allows, and the rest stays in force.
- No waiver. If we do not enforce a term at once, we can still enforce it later.
- Independent parties. These terms do not create a partnership, employment or agency relationship. Nobody else has rights under them.
- Language. We write these terms in English. If we translate them, the English version controls, unless the law requires otherwise.
